I don’t buy into the idea that every ruling Trump loses is due to an activist judge, but I will also be the first person to admit that this administration often gets the short end of the stick in the courtroom.
Over the last two weeks, the courts have handed down some baffling rulings and decisions.
We are seeing rulings on ideology rather than the Constitution, and that is not the way the judiciary is supposed to work.
One of the recent cases that really got under my skin was a judge in Louisiana who released four criminal illegals who had been convicted of heinous crimes.
DHS spokesperson Tricia McLaughlin explained, “Judge John deGravelles, appointed by Barack Obama, released FOUR violent criminals back onto American communities, and unfortunately, the ramifications will only be the continued rape, murder, assault, and robbery of more American victims.”
She continued, “Releasing these monsters is inexcusably reckless. President Trump and Secretary Noem are now enforcing the law and arresting illegal aliens who have no right to be in our country. We are applying the law as written. If an immigration judge finds an illegal alien has no right to be in this country, we are going to remove them. Period.”
We are not talking about people who “only” crossed the border or stole a loaf of bread. These are serious crimes, and they have been released to again terrorize American communities.
Mohsen Mahdawi’s deportation was halted this week by Judge Nina Froes.
Mahdawi led protests at Columbia University against Israel during the war in Gaza.
According to Froes, the DOJ made a procedural mistake in not properly certifying a document that was to be submitted as evidence in the case.
Mahdawi stated, “I am grateful to the court for honoring the rule of law and holding the line against the government’s attempts to trample on due process. This decision is an important step towards upholding what fear tried to destroy: the right to speak for peace and justice.”
Finally, we come back to Kilmar Abrego Garcia, the now infamous alleged gang member and human trafficker.
U.S. District Judge Paula Xinis, another Obama appointee, said the DHS cannot detain Abrego Garcia, claiming that the government “made one empty threat after another to remove him to countries in Africa with no real chance of success.”
She added, “From this, the Court easily concludes that there is no ‘good reason to believe’ removal is likely in the reasonably foreseeable future.”
Bondi has repeatedly claimed they have an air-tight case against Abrego-Garcia, yet we have yet to see much movement on that front. Between these three cases, it is a deadly combination of activism and sloppy work on the part of Bondi’s DOJ. I just cannot imagine that Trump is going to tolerate this for much longer.
