The most famous deportee during the Trump administration is now trying have his charges dismissed.
Kilmar Abrego Garcia still has criminal charges pending, but now he is claiming this is all vindictive.
The administration, however, painted him as a child trafficker and drug dealer.
Garcia’s family and claim the man to be a saint, and Democrats took up his case after he was deported to an El Salvador prison.
The administration linked Garcia to dangerous gangs as well as human trafficking operations, fighting his deportation.
He found a sympathetic judge, and when he was removed from the El Salvador prison, his attorney immediately moved to have him freed from jail.
He was eventually released, with this attorney stating, "He is grateful that his access to American courts has provided meaningful due process.”
The Department of Justice never backed off, and it pursued criminal charges against Garcia after his initial release.
While prosecutors initially stated the DOJ had no role in charges being filed in Tennessee against Garcia, emails proved that to be wrong.
This was noted in the judge’s ruling, with Judge Crenshaw stating, “These documents show that McGuire did not act alone and to the extent McGuire had input on the decision to prosecute, he shared it with Singh and others.”
He continued, “Specifically, the government’s documents may contradict its prior representations that the decision to prosecute was made locally and that there were no outside influences.”
Garica has won at virtually every aspect of this case, so why not try to have the entire case tossed… and that is what he is doing.
His attorneys have filed a motion to have the case against Garcia dismissed, claiming this prosecution was vindictive from the start.
The motion was set up by the judge’s comments during the case, but there is definitely evidence that something fishy was going on, more specifically, the bodycam footage during a traffic stop of Garcia in Tennessee.
If the charges against him are dismissed, this will be a nightmare for the administration. They went all-in with this case. I keep waiting for the shoe to fall with Attorney General Pam Bondi, and I think a loss of this case could be it.
