I believe that most of us are often stunned by how different ideologies come into play when discussing the law and cases brought against the Trump administration, in particular.
You can almost predict how a given decision will come down, solely by knowing who appointed the presiding judge.
Now, judges are coming forward to rip the U.S. Supreme Court for overturning rulings they have made, claiming that such decisions are putting their safety and that of their famiies at risk.
Donald Trump has seen his fair share of activist judges rule against him, as their motivation often seemed clear. But I have also stated on numerous occasions that while I was not happy with some of the rulings rendered against the president, the decisions were correct based on the Constitution.
But judges want us to think that they are right all the time, which is far from the case, as we see when things play out in the appeals process.
But today’s world being what it is, some people take their disagreements way too far, even threatening judges after rulings against the president's interests are made, actions some of those jurists now blame on Trump’s own rhetoric.
One judge who blocked Trump’s freeze on federal aid, Jack McConnell, noted how he received more than 400 threatening voicemails after his ruling.
While the media always makes a big deal whenever Trump criticizes a judge, it ignores the blatant threats made by Democrats against top jurists, in particular, those who sit on our Supreme Court.
We all remember Sen. Chuck Schumer (D-NY) blatantly threatening conservative justices outside the steps of the Supreme Court, an action he later shrugged off, stating, “I’m from Brooklyn” to justify his comments, which were clearly made to provoke violence against conservatives such as Justice Brett Kavanaugh, whom he specifically named in his rant.
Democrats have literally threatened justices before rulings have even come down, with Sen. Sheldon Whitehouse (D-RI) warning that if a gun rights decision did not come down in a manner to his liking, Democrats would add justices to the bench to swing the majority back to liberals.
As Jonathan Turley wrote, “Sadly, none of this appears to warrant more media coverage or analysis. It appears from that lack of coverage that there is less of a Brooklyn than of a Democratic license when it comes to attacks on the judiciary.”
Now, some federal judges who have been deemed to be activists by the Trump administration are anonymously expressing their frustration with the Supreme Court for not backing up their rulings, but that is not the role of the Supreme Court. One judge stated, "It is inexcusable. They don’t have our backs."
To be clear, I do not support the rhetoric by Trump, as that is not his role. He needs to leave that up to us in the media. But I also do not support the threats being made against judges in any instance. But there is no denying the fact that some judges have a real case of TDS and are making rulings on feelings rather than the law.
To that very point, a judge appointed by Barack Obama blew the whistle on some of his fellow liberal judges, admitting, "The whole ‘Trump derangement syndrome’ is a real issue. As a result, judges are mad at what Trump is doing or the manner he is going about things; they are sometimes forgetting to stay in their lane.”
We have far too many jurors on the bench who are clearly activists, and that needs to end, but we don’t do that by threatening them. We do that by putting people in office on both sides of the aisle who will choose judges by ability rather than ideology. Sadly, that is no longer the case, and I believe Democrats are far more guilty of this than Republicans. The hearings during the Biden administration were pathetic, as Senator Kennedy (R-LA) exposed fraud after fraud, unable to answer the most basic of legal questions, but the Democrats just rammed them through. Now, those same judges are upset that the Supreme Court does not have their backs. Well, issue a decision based on the Constitution rather than your feelings, and perhaps the Court would back you up.
