Well, things just got a lot more interesting for Fulton County, Georgia, D.A. Fani Willis.
After Willis was disqualified from prosecuting the case against Donald Trump, her replacement declined to pursue the matter, but things are apparently not over yet.
Now, Trump is suing Willis to recover legal fees spent defending against the charges she brought.
Conflicts of interest were prevalent in Willis' prosecution of Trump, most notably, her affair with the man she selected to help try the case.
Willis was criticized for overseeing a case that was going nowhere, and she was eventually removed from further involvement after Trump’s legal team filed a motion for her disqualification.
The D.A. responded, “While I disagree with the decision of the Georgia Court of Appeals and the Georgia Supreme Court’s divided decision not to review it, I respect the legal process and the courts.”
She continued, “Accordingly, my office will make the case file and evidence available to the Prosecuting Attorneys Council for use in the ongoing litigation. I hope that whoever is assigned to handle the case will have the courage to do what the evidence and the law demand.”
Pete Skandalakis, executive director of the Prosecuting Attorneys' Council of Georgia, was appointed by the court to find a replacement to try the case, but he eventually took the lead himself.
At first, I thought he was going to take a swing at Trump, but then he decided to drop the case rather than have it sit for years during the president's second term in office.
He then used a jurisdictional angle to justify his abandonment of the case, stating, "The criminal conduct alleged in the Atlanta Judicial Circuit's prosecution was conceived in Washington, D.C., not the State of Georgia. The federal government is the appropriate venue for this prosecution, not the State of Georgia."
Fulton Superior Judge Scott McAfee agreed with the overall decision not to pursue the matter, announcing, "The case is hereby dismissed in its entirety.”
That argument used to secure that outcome may now give Trump a very good chance at winning his latest lawsuit, which seeks more than $6 million in recovery of legal fees spent on the underlying case.
Steve Sadow, Trump's lead attorney in Georgia, announced, "In accordance with Georgia law, President Trump has moved the Court to award reasonable attorney fees and costs incurred in his defense of the politically motivated, and now rightfully dismissed, case brought by disqualified DA Fani Willis.”
This case has already cost Fulton County millions, so I am sure this is not going to sit well with voters. If Trump wins, they get to add another $6 million to an already hefty price tag for the failed attempt to prosecute.
Willis will clearly fight back, so we just have to wait to see if her argument holds water or if Trump gets a fat check. Rest assured, if Trump wins this case, it could spell the end of Willis’ legal career. It’s tough to imagine her winning election to office again after hitting taxpayers with these rather significant bills.
